Terms of Service
These terms are the agreement between you and Kiwaro for use of the app. By installing or using Kiwaro you accept them. If you do not accept them, do not use the app.
1. Who we are

2. What these terms cover
Your licence to use the app is Apple’s Licensed Application End User Licence Agreement, which applies to every App Store app that does not supply its own. These terms cover the commercial relationship only: what is free, what Pro costs, and your rights as a consumer.
There is no account. These terms apply from the moment you install the app.
3. The free plan
Two recordings or imports per day, up to 30 minutes each. Includes transcription, search, folders, trimming, export to TXT/SRT/VTT, and a backup copy in a folder you choose. Limits reset at 00:00 in your device time zone.
4. Subscriptions
Monthly or annual auto-renewing subscription. Apple is the seller of record. The purchase contract is with Apple, Apple takes the payment and issues the receipt, and we never see your card details. Renews at the end of each period unless cancelled at least 24 hours before. Deleting the app does not cancel a subscription.
5. The free trial
14 days. Your card is held by Apple and nothing is charged during the trial. On day fifteen it becomes the plan you chose unless you cancel at least 24 hours before. One trial per Apple Account.
6. Right of withdrawal
You have 14 days to withdraw from a distance contract, without giving a reason, counted from the day the contract is concluded. This applies to consumers and to sole traders buying something unconnected with their professional activity. It is separate from the trial.
Pro is digital content supplied immediately. Under Article 38(1)(13) of the Consumer Rights Act the right lapses only if all three are true: you expressly consented to supply beginning before the 14 days were up, you acknowledged that this ends the right, and you received confirmation. The App Store presents all three before payment.
If you use the free trial, nothing has been paid, so cancelling inside it achieves the same result.
How: through Apple at reportaproblem.apple.com, or Settings › [your name] › Purchase History. You may also email info@sugori.com. No particular form is required.
Model form: “I hereby give notice that I withdraw from my contract for the purchase of Kiwaro Pro. Ordered on: [date]. Name: [name]. Address: [address]. Date: [date].”
Refunds are issued by Apple to the original payment method, normally within 14 days.
7. Your recordings, and recording other people
Your recordings are yours. We claim no licence over them, because we never receive them. You are responsible for having a lawful basis to record other people. In Poland, recording a conversation you take part in is generally lawful; publishing it may not be, and recording a conversation you are not part of can be an offence under Article 267 of the Penal Code.
8. If something is wrong
Digital content must conform to the contract. Under Articles 43h–43q of the Consumer Rights Act, implementing Directive (EU) 2019/770, you may require conformity to be restored; if that is impossible, disproportionate or not done in reasonable time, you may demand a price reduction or withdraw. These remedies cost you nothing. Nothing here excludes liability that cannot be excluded by law.
9. Complaints
Send a complaint (reklamacja) to info@sugori.com and we will answer within 14 days. If you are not satisfied you may use the out-of-court routes listed under Governing law below.
10. Changes
We may change these terms for legal or product reasons and will say so in the app before material changes take effect.
11. Governing law
Polish law. If you are a consumer you keep the mandatory protections of the law where you live, and may bring proceedings in your local courts under Regulation (EU) 1215/2012. Out-of-court routes for consumers: the provincial Trade Inspection (wojewódzki inspektor Inspekcji Handlowej), a permanent consumer arbitration court, a municipal or district consumer ombudsman, or a consumer organisation.
